“文化大革命”结束了。那种少数人无法无天的日子一去不复返了。中国要恢复法律的尊严。古人云：王子犯法与庶民同罪。如果把陈伯达只列入党内审查，很多高级干部不同意，许多群众也不能答应。

1980年冬季，一个姗姗来迟的被告走上法庭，他是江青反革命集团中最后一个出场的。出场的前一天，他问监管员：“明天是不是该审我了？”“你怎么知道的？”监管员知道通知他的时候还未到，有些惊异地望着他。“是我计算的，前面四个我估计已审完了，该轮到我了。”这一天是1980年11月27日。问话的是头脑仍然很清醒的陈伯达。

众所周知，起诉书中没有按1971年12月11日，经毛泽东批准中共中央下发的《粉碎林陈反党集团反革命政变斗争》等材料去认定陈伯达的罪行，包括1971年批发中央专案组《关于国民党###分子、托派、叛徒、特务、修正主义分子陈伯达的反革命历史罪行的审查报告》。这是中央“两案”领导小组和“两案”审判指导委员会在组织进行“两案”审判准备工作的一条根本原则，属于党内路线错误的问题，列入党内审查的范畴，不作犯罪事实起诉。

在起草起诉书中，经中共中央、中央纪律检查委员会和“两案”领导小组决定，对陈伯达在庐山的一系列活动不提出起诉，实事求是地遵照法律原则，只追究陈伯达触及法律的事实。

经侦查，认定前中央政治局常委、“中央文革小组”组长陈伯达以推翻人民民主专政为目的，积极参与林、江反革命集团，是反革命集团主犯。

起诉书送到后，陈伯达监号里传出哭泣声。

冬日里的寒风卷着一个老头儿的哭声在狱中空旷的空间里翻滚，很可悲。

11月1日，陈伯达找工作人员谈话，说：

“我的精神、肉体都是属于党的，党对我怎么处理都行。”

他陈述了对起诉书中一系列细节上的辩解，然后说：

“我的问题是党内问题，运动开始哪有不犯错误的？党内处理可以体谅，现在罪大恶极，怎么处理都行，但不是救人的办法。”

最后，他又目光飘忽地说：

“如果毛主席还在，说一句话就好了。我不轻易流泪，今天我哭了，现在没有办法了。”

最后这句话道出了陈伯达的心迹。
