问：董老师您好！再过几天就是2004年了，在这里我们提前祝您新年好，祝您在新的一年里身体康健。时光荏苒，到2004年，我们国家1954年宪法颁布实施已整整五十年了。您五十年前曾亲历这部中国历史上第一部社会主义宪法的起草工作，作为学生我们为老师的贡献由衷地感到自豪，同时我们想在1954年宪法颁布五十周年到来之际请老师再对制定1954年宪法时的一些历史情况作些回忆，回答我们的一些问题。

您当年是由中国人民大学法律系借调到宪法起草委员会的吧，请介绍一下您借调前后的情况。

答：我1951年从北京大学政治系毕业后被分配到了中国人民大学法律系国家法教研室。1953年到1954年，我从中国人民大学法律系借调国务院政法委办公室，随后又被借调到由邓小平同志领导的选举法起草委员会，中华人民共和国宪法起草委员会成立后我就借调到起草委员会了。1954年宪法起草工作结束后，我又被借调到中华人民共和国第一届全国人民代表大会办公室工作。

问：请您简要介绍一下当时宪法起草委员会成立的背景。

答：宪法的起草最初是由中共中央提到中国人民政治协商会议全国委员会，建议开始筹备宪法起草，再由中国人民政治协商会议全国委员会向中央人民政府提出建议。1953年1月13日，中央人民政府委员会第20次会议作出决定，成立以毛泽东为首的中华人民共和国宪法起草委员会，负责宪法起草工作。

问：宪法起草委员会的人员组成情况，您还记得吗？

答：宪法起草委员会大概有委员33人，包括中国共产党、各民主党派、各人民团体的负责人、社会公众领袖和专家们。我记得，在杭州起草宪法期间，除了我们直接参与起草的人员外，还由董必武、彭真、张际春等组成研究小姐，聘请当时著名的法学家周鲠生、钱端升为法律顾问，叶圣陶、吕叔湘为语文顾问。

问：宪法起草委员会成立后宪法起草工作是怎样开展的？

答：1953年毛泽东带着当时的中央政治研究室主任陈伯达，副主任田家英和胡乔木等到杭州，在毛泽东的亲自领导和参加下进行工作。起草工作从1954年1月7日到3月9日共进行了两个多月，其间草拟了100条条文，这是中华人民共和国宪法草案的最初稿。当时还编辑了三辑资料，叫《宪法参考资料》。第一辑是1918年苏俄宪法和1924年苏联宪法；第二辑是美、英、法、德意志和瑞士联邦宪法；第三辑是从清朝、北洋军阀到国民党蒋介石的宪法和宪法性文件。第三辑资料于1953年3月以中央人民政府委员会办公厅的名称印刷后发放，发给所有宪法起草委员会的委员以及参与宪法起草工作的有关人员。
